These Terms of Service ("Terms") govern your use of our website, services, and any related content (collectively, the "Services") provided by Elevate Business Coaching ("we," "our," or "us"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

We reserve the right to modify these Terms at any time. We will always post the most current version on our website. By continuing to use our Services after any modifications, you agree to be bound by the updated Terms.

2. Services Description

Elevate Business Coaching provides business coaching, consulting, and training services to individuals and organizations in India. Our Services may include one-on-one coaching sessions, group workshops, digital content, assessment tools, and other resources designed to support business growth and leadership development.

We make no guarantees about the results or outcomes of using our Services. Success depends on many factors, including your commitment, circumstances, and how you apply the information and strategies provided.

3. User Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you meet this eligibility requirement and that you have the legal authority to enter into these Terms.

If you are accessing our Services on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

4. Account Registration

Some of our Services may require you to register for an account. When you register, you agree to provide accurate, current, and complete information about yourself and to update this information as necessary to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

5. Payment Terms

Fees for our Services are displayed on our website or provided in separate agreements. All fees are in Indian Rupees (INR) unless otherwise specified and are exclusive of applicable taxes.

Payment must be made according to the terms specified at the time of purchase. We reserve the right to modify our pricing at any time, with or without notice. Any changes in pricing will not affect previously purchased Services.

Refunds are provided in accordance with our Refund Policy, which is incorporated into these Terms by reference.

6. Cancellation and Rescheduling

For coaching sessions and scheduled events, our cancellation and rescheduling policies will be provided at the time of booking. Generally, we require at least 48 hours' notice for any cancellation or rescheduling request.

If you cancel or reschedule with less than the required notice, you may forfeit the session or be charged a cancellation fee as specified in the booking terms.

7. Intellectual Property

All content provided as part of our Services, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, software, and the compilation of all content, is our property or the property of our licensors and is protected by Indian and international copyright laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our content for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our content without our express written permission.

8. User Content

You may be able to submit content to us, including but not limited to feedback, testimonials, comments, and questions ("User Content"). By submitting User Content, you grant us a worldwide, perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content throughout the world in any media.

You represent and warrant that your User Content does not violate any third-party rights, including privacy, publicity, copyright, trademark, or other intellectual property rights, and that it does not contain any material that is false, defamatory, or otherwise unlawful.

9. Confidentiality

We respect the confidentiality of the coaching relationship. Information shared during coaching sessions is treated as confidential, subject to legal requirements and our Privacy Policy. However, testimonials, case studies, and other success stories may be shared with your explicit permission.

You agree to maintain the confidentiality of any proprietary or confidential information shared by us during the provision of our Services, including but not limited to coaching methodologies, frameworks, and materials.

10. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS, IF ANY, WILL BE CORRECTED. WE MAKE NO REPRESENTATIONS ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE CONTENT OR SERVICES.

11. Limitation of Liability

IN NO EVENT SHALL WE, OUR AFFILIATES, OR OUR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (iii) ANY CONTENT OBTAINED FROM THE SERVICES; AND (iv) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

12. Indemnification

You agree to defend, indemnify, and hold harmless Elevate Business Coaching, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding relating to your access to or use of the Services shall be instituted in the courts located in Mumbai, Maharashtra, India, and you agree to submit to the personal jurisdiction of such courts.

14. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
